By accessing or using PromoTrack ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and PromoTrack regarding your use of our advertising campaign management platform.
2. Description of Service
PromoTrack is an advertising campaign management platform that allows users to:
- Create and manage advertising campaigns on Facebook/Meta platforms
- Upload and manage creative assets (videos, images)
- Configure campaign targeting and budgets
- Monitor campaign performance and analytics
- Connect and manage Facebook/Meta ad accounts
3. Account Registration
To use PromoTrack, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities that occur under your account
4. Facebook/Meta Integration
By connecting your Facebook account to PromoTrack, you:
- Authorize us to access your Facebook ad accounts and pages
- Agree to comply with Facebook's Terms of Service and Advertising Policies
- Understand that we act on your behalf when creating campaigns
- Acknowledge that Facebook may reject campaigns that violate their policies
- Accept responsibility for all advertising costs incurred through your ad accounts
PromoTrack is not responsible for changes to Facebook's API, policies, or services that may affect your campaigns.
5. User Content and Creative Assets
You retain ownership of all content you upload to PromoTrack. By uploading content, you:
- Grant us a license to store, process, and transmit your content to provide the Service
- Represent that you have the right to use and share the content
- Agree not to upload content that infringes on intellectual property rights
- Accept responsibility for ensuring your content complies with advertising regulations
6. Prohibited Uses
You agree not to use PromoTrack to:
- Violate any applicable laws or regulations
- Create misleading, deceptive, or fraudulent advertisements
- Advertise prohibited products or services (weapons, drugs, adult content, etc.)
- Infringe on the intellectual property rights of others
- Harass, discriminate against, or harm others
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Use automated means to access the Service without permission
- Resell or redistribute the Service without authorization
7. Payment and Billing
PromoTrack may offer paid subscription plans. By subscribing:
- You agree to pay all fees associated with your selected plan
- Subscriptions may renew automatically unless cancelled
- Refunds are provided in accordance with our Refund Policy
- We reserve the right to change pricing with reasonable notice
Note: Advertising costs charged by Facebook/Meta are separate from PromoTrack subscription fees and are billed directly by Facebook to your connected ad account.
8. Intellectual Property
PromoTrack and its original content, features, and functionality are owned by PromoTrack and are protected by international copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Service without express written permission.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties that the Service will be uninterrupted or error-free
- Warranties regarding the accuracy or reliability of results
- Warranties that defects will be corrected
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMOTRACK SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Advertising costs or campaign performance
- Actions taken by Facebook/Meta regarding your ad account or campaigns
- Third-party content or services
Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless PromoTrack and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of third parties.
12. Termination
We may terminate or suspend your account and access to the Service:
- For violations of these Terms
- For illegal or fraudulent activity
- At our sole discretion with or without notice
You may terminate your account at any time by contacting us or using account deletion features. Upon termination, your right to use the Service ceases immediately.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
