1) Intended use — research only
All products are intended solely for laboratory and research use and are not for human or animal consumption, injection, inhalation, transdermal application, compounding, clinical or diagnostic use, or for use in medical devices, cosmetics, food, or drug applications.

2) Age Eligibility Requirement
Purchasers must be eighteen (18) years of age or older.
3) Qualified Handling
Products must be handled by trained professionals in appropriately controlled laboratory environments. No license or patent rights are granted or implied by the sale or listing of these materials. The buyer acknowledges the inherent hazards associated with research compounds and agrees to use appropriate personal protective equipment (PPE), engineering controls, and standard operating procedures (SOPs).
4) Buyer Responsibilities
Buyers are responsible for conducting independent due diligence regarding product hazards, storage, handling, and disposal. Buyers must comply with all applicable local, state, federal, and international laws and regulations and confirm that the acquisition, possession, and research use of the products are lawful for their organization and location.
5) Product Testing & Compliance
Products are not intended for commercial manufacture of foods, drugs, medical devices, or cosmetics. You are solely responsible for conducting any testing, validation, or verification required for your research protocols and compliance obligations. No products or statements on this Site are approved by the FDA or any regulatory authority, and you agree not to represent otherwise.
6) TSCA & Regulatory Status
Unless expressly stated otherwise, products may not be listed on the TSCA Inventory. The buyer is responsible for determining TSCA applicability and for complying with any required pre-manufacture notices, exemptions, or reporting obligations prior to any non-exempt use.
7) Resale & Relabeling
Products are not intended for resale. If you repackage, relabel, or incorporate products as components, you assume full responsibility for regulatory compliance and for the accuracy of any specifications, testing, or assay results you represent.
8) Export Controls
Certain products may be subject to U.S. export control laws and economic sanctions. You agree not to export, re-export, transfer, or otherwise provide products in violation of applicable laws or regulations.
9) Limitation of Liability
To the fullest extent permitted by law, OptimalPep shall not be liable for any indirect, special, incidental, or consequential damages. You agree to indemnify and hold harmless OptimalPep, its owners, and affiliates from any claims arising from the handling, use, or misuse of products. All products are used at your own risk and are provided “AS IS.”
10) Orders, Returns & Refusals
OptimalPep reserves the right to refuse, cancel, or restrict any order deemed non-compliant with these Terms. Due to the research-grade nature of our products, opened items are not eligible for return. Unopened items may be reviewed for return eligibility at our sole discretion, subject to safety, integrity, and chain-of-custody considerations.
11) Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. Exclusive jurisdiction and venue for any dispute arising under or related to these Terms shall lie in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. OptimalPep may update these Terms from time to time, and continued use of the Site constitutes acceptance of any revised Terms.
