I wish to apply for affiliation as a driver with Suncoast Cabs or Black & White Cabs Pty Ltd (“Black & White Cabs”) and that Suncoast Cabs or Black & White Cabs has requested me to enter into this performance contract.
I (or will be at the time of consideration of this application) hold a current BHTX authorisation under the Queensland Transport Legislation.
I have undergone a recognised training programme and I have gained an awareness of the following:

the obligations of a BHTX license holder under the Queensland Transport Legislation;
the Rules of Operation and the Policies and Procedures of Suncoast Cabs or Black & White Cabs;
the contents of the Black & White Cabs Handbook;
the Black & White Cabs or Suncoast Cabs expectations in regards to quality customer service;
the terms and conditions which attach to taxi service licences; and
the operation of the provided dispatch equipment and, in particular, the operation and testing of the alarm facility and the security camera system fitted to affiliated vehicles.

If affiliation is granted to me, I agree:

to comply with the Transport Legislation;
to comply with the Rules of Operation and the Policies and Procedures of Black & White Cabs or Suncoast Cabs;
to co-operate and comply with all reasonable requests of Black & White Cabs or Suncoast Cabs;
to undertake such further training as considered necessary by Black & White Cabs or Suncoast Cabs;
to notify Black & White Cabs or Suncoast Cabs of any change to my personal details stated in this application; and
to always be in an approved taxi fitted with Company owned, operated and/or controlled equipment supplied by Black & White Cabs or Suncoast Cabs.

• I acknowledge:

that if I breach the Transport Legislation, the Rules of Operation or the Policies and Procedures of Black & White Cabs or Suncoast Cabs, it renders me liable to disciplinary procedures which may include monetary penalties;
that I am or will be an independent contractor under a written bailment agreement with an affiliated operator and that I am not an employee of either any affiliated operator, Black & White Cabs or Suncoast Cabs;
that any affiliation granted to me is personal to me; and
that Black & White Cabs or Suncoast Cabs will from time to time dispatch fixed price fares the price of which is determined by meter costs. If I accept a fixed price booking I must complete the job at the advertised fixed price rate.

I authorise Black & White Cabs or Suncoast Cabs to make enquiries with respect to my criminal history and/or traffic history in order to consider whether I am a suitable person to hold or continue to hold affiliation with Black & White Cabs or Suncoast Cabs.

Black & White Cabs or Suncoast Cabs to publish details of my name, address, telephone number and other details related to my affiliation to affiliated operators. I understand and authorise that personal record details will & maybe circulated to others on occasion.
Black & White Cabs or Suncoast Cabs to store a photograph of me and that this photograph may be used from time to time in advising customer of booking details or for other purposes.

I agree to indemnify and keep indemnified Black & White Cabs or Suncoast Cabs against any loss or damage that Black & White Cabs or Suncoast Cabs may suffer arising out of or in connection with any action or lack of action on my part in circumstances where such liability has arisen out of any non-compliance under this performance contract.
I agree and understand that upon receipt of advice from a Taxi Operator the existence of a debt between myself and my Bailor/Operator/Creditor related to my Taxi business, I cannot drive for another operator within the network of Black & White Cabs Pty Ltd or Suncoast Cabs until the debt has been satisfied, or arrangements to satisfy the debt have been made with the Bailor/Operator to whom the debt is owed.

IMPORTANT INFORMATION

Background

The DVD is a part of the NSW Point to Point Commission Portal. It is a safety management tool to assist Authorised Service Providers (ASP) to meet the requirements of the new point to point legislation in ensuring their drivers are eligible to provide point to point transport services.

What information will the ASP obtain from a check?

Once you provide your consent, the ASP will be able to enter your surname, date of birth and driver licence number into the DVD. The DVD will then confirm whether or not you are an eligible driver and if you have any criminal, serious driving or point to point safety offences recorded against your name. If the DVD results show that an offence has been recorded, it does not detail what this offence is. These checks can be conducted as often as the ASP believes appropriate in order to meet their safety obligations under point to point transport law.

What happens if you don’t consent?

It is voluntary to provide your consent to the disclosure of personal information requested in this form. However, without your consent, the ASP may not be able to verify whether you are eligible to be a passenger service driver under point to point transport law.

How long is consent valid?

Your consent will remain valid for 12 months but will end sooner if you cancel or cease employment with the ASP.

Cancelling consent

You may cancel your consent at any time by notifying the ASP in writing. After that, they will not be entitled to check your driver licence details and therefore, your eligibility as a driver.

Privacy notice

The ASP is collecting your personal information for the purpose of assessing your eligibility as a driver under point to point transport law. Your personal information includes your surname, date of birth, driver licence number, as well as any records of criminal offences, serious driving offences or point to point safety offences. It is voluntary to provide your consent for the ASP to access your personal information. However, if you do not consent, then this could affect the ASP’s assessment of your eligibility to be a passenger service driver. The ASP will hold your personal information and not otherwise use or disclosure it except as authorised by law. If you wish to access your personal information, please contact the ASP.

Privacy complaints

If you believe the ASP has obtained your driver licence information without your consent or has misused that information, then you should notify the ASP. If you are not satisfied with the outcome, you can raise the matter by contacting:

B. I confirm that I currently hold, or will hold at the time of consideration, a valid Passenger Transport Licence issued by Roads and Maritime Services, as required under New South Wales Transport Legislation.

C. I confirm that I have successfully completed a recognised training program and have been made aware of the following:

My obligations under relevant Federal and State anti-discrimination legislation, as well as the Transport Legislation;
The obligations under the Passenger Transport Licence Code as outlined by the Point to Point Transport Act 2016 and any subsequent amendments;
The Rules of Operation, Policies, and Procedures of Black & White Cabs;
The contents of the Black & White Cabs Handbook;
The expectations of Black & White Cabs regarding high-quality customer service;
The terms and conditions associated with taxi service licences; and
The proper operation of the dispatch equipment, including the alarm system and security cameras installed in affiliated vehicles.

D. If my affiliation is granted, I agree to:

Comply with the Passenger Transport Licence Code in New South Wales;
Follow the Rules of Operation, Policies, and Procedures of Black & White Cabs;
Co-operate fully with all reasonable requests made by Black & White Cabs;
Undertake any additional training required by Black & White Cabs;
Notify Black & White Cabs within 21 days of any changes to my personal details provided in this application; and
Only operate in an approved taxi fitted with Black & White Cabs’ equipment.

E. I acknowledge and accept that:

Breaching the Passenger Transport Licence Code, the Rules of Operation, or the Policies and Procedures of Black & White Cabs may subject me to disciplinary measures, including monetary penalties;
I am, or will be, an independent contractor operating under a written bailment agreement with an affiliated operator, and I am not an employee of either the affiliated operator or Black & White Cabs;
My affiliation is personal and non-transferable; and
I will complete any fixed-price fare bookings at the advertised rate, as determined by meter costs.

F. I authorise Black & White Cabs to conduct checks on my criminal and/or traffic history to assess my suitability for affiliation.

G. I authorise Black & White Cabs to:

Share my name, address, and other relevant details with affiliated operators, and circulate my personal record details when necessary;
Store and use my photograph for customer bookings and other operational purposes; and
Access the Driver Vehicle Dashboard (DVD) to verify my eligibility to drive a taxi.

H. I agree to indemnify Black & White Cabs against any loss or damage arising from my actions or omissions, particularly where such actions result in non-compliance with this performance contract.

I. Obligations Regarding Tolls, Levies, and Other Charges:

I acknowledge that as part of my affiliation, I will enter into a bailment agreement with an affiliated operator. Under this agreement, I will be the person in control of the vehicle during its operation and responsible for the collection of fares. As such, I understand and agree that I am solely responsible for the payment of all tolls, levies, and other applicable charges incurred during the course of providing taxi services.

I further acknowledge that it is my obligation to ensure all such payments are made in full and in a timely manner. Failure to comply with these responsibilities may result in disciplinary action or other penalties, in accordance with the rules and procedures of Black & White Cabs.

J. I understand that if I have an outstanding debt with my Bailor, Operator, or Creditor in relation to my taxi business, I will not be permitted to drive for another operator within the Black & White Cabs network (including RSL Cabs and Southern Cross Cabs) until the debt is settled or arrangements are made to resolve it.

K. I acknowledge that this document may be executed electronically to the extent permitted by law.

L. I accept that these terms and conditions may be updated from time to time, and I agree to adhere to any updated terms following notification from Black & White Cabs.

the obligations of a Commercial Passenger Vehicle Authorisation holder as determined by the Commercial Passenger Vehicle Industry Act 2017 and subsequent amendments made to the act;
the Rules of Operation and the Policies and Procedures of Black & White Cabs;
the contents of the Black & White Cabs Handbook
the Black & White Cabs expectations in regards to quality customer service;
the terms and conditions which attach to taxi service licences; and
the operation of the provided dispatch equipment and, in particular, the operation and testing of the alarm facility and the security camera system fitted to affiliated vehicles.

D. If affiliation is granted to me, I agree:

to comply with the rules that govern the Commercial Passenger Vehicle Authorisation in Victoria;
to comply with the Rules of Operation and the Policies and Procedures of Black & White Cabs;
to co-operate and comply with all reasonable requests of Black & White Cabs;
to undertake such further training as considered necessary by Black & White Cabs;
to notify Black & White Cabs of any change to my personal details stated in this application; and
to always be in an approved taxi fitted with Company owned, operated and/or controlled equipment supplied by Black & White Cabs.

E. I acknowledge:

that if I breach the Transport Legislation, the Rules of Operation or the Policies and Procedures of Black & White Cabs, it renders me liable to disciplinary procedures which may include monetary penalties;
that I am or will be an independent contractor under a written bailment agreement with an affiliated operator and that I am not an employee of either any affiliated operator or Black & White Cabs;
that any affiliation granted to me is personal to me; and
that Black & White Cabs will from time to time dispatch fixed price fares the price of which is determined by meter costs. If I accept a fixed price booking I must complete the job at the advertised fixed price rate.

F. I authorise Black & White Cabs to make enquiries with respect to my criminal history and/or traffic history in order to consider whether I am a suitable person to hold or continue to hold affiliation with Black & White Cabs.

G. I authorise:

Black & White Cabs to publish details of my name, address, telephone number and other details related to my affiliation to affiliated operators. I understand and authorise that personal record details will & maybe circulated to others on occasion.
Black & White Cabs to store a photograph of me and that this photograph may be used from time to time in advising customer of booking details or for other purposes.

H. I agree to indemnify and keep indemnified Black & White Cabs against any loss or damage that Black & White Cabs may suffer arising out of or in connection with any action or lack of action on my part in circumstances where such liability has arisen out of any non-compliance under this performance contract.

I. I agree and understand that upon receipt of advice from a Taxi Operator the existence of a debt between myself and my Bailor/Operator/Creditor related to my Taxi business, I cannot drive for another operator within the network of Black & White Cabs Pty Ltd until the debt has been satisfied, or arrangements to satisfy the debt have been made with the Bailor/Operator to whom the debt is owed.

To the extent permitted by law, this document may be executed electronically, including by using software or a platform for the electronic execution of contracts.

These terms and conditions may be updated periodically. Drivers will be notified of any changes and are required to adhere to the updated terms.

Use of Company-Provided Tablets and SIM Cards

I acknowledge and agree to the following terms regarding the use of company-provided tablets and SIM cards:

Purpose: The tablets and SIM cards provided by Black & White Cabs are intended solely for dispatching taxi work and other tools necessary for driving a taxi. They must not be used for any personal activities, including but not limited to streaming videos, accessing social media, or any other non-work-related purposes.
Security: The tablets are equipped with security software (Knox) to ensure proper use. I agree not to attempt to bypass, disable, or otherwise interfere with the security measures installed on the tablets.
Access to SIM Cards: I understand that tampering with or removing the SIM cards from the tablets is strictly prohibited. Unauthorised access to the SIM cards for personal data usage is a violation of company policy.
Data Usage: I acknowledge that any unauthorised use of data can incur significant costs. I agree to use the provided data only for work-related purposes and to refrain from any activities that could lead to excessive data usage.
Monitoring and Compliance: I consent to the monitoring of tablet and SIM card usage by Black & White Cabs to ensure compliance with these terms. I understand that any misuse may be detected and addressed promptly.
Reporting and Resolution: I agree to report any issues, suspected security breaches, or misuse of tablets and SIM cards to Black & White Cabs immediately. Support and guidance will be provided to resolve such issues.
Training and Support: I acknowledge that training and support are available to help me understand how to use the tablets properly and comply with security measures. I will participate in any required training sessions.
Consequences of Misuse: I understand that any violation of these terms, including unauthorised use of the tablets, bypassing security measures, or misuse of SIM cards, will result in disciplinary action. This may include but is not limited to, monetary penalties, suspension, or termination of my affiliation with Black & White Cabs.
Updates to Terms and Conditions: I acknowledge that these terms and conditions may be updated periodically. I will be notified of any changes and agree to adhere to the updated terms.
Authority Withdrawal: I understand that at any time my authority to access company-owned, operated, and/or controlled equipment can be withdrawn by the General Manager at any time in line with general company rules and operating procedures.
